LOK SABHA APPROVES CHANGES IN DEBT RECOVERY BILL

 
The Lok Sabha on December 10 approved an amendment Bill to make easier recovery of bad loans by banks amid walkout by the BJP, Left and some other parties after the government rejected their demand for referring it to the Standing Committee.

The Enforcement of Security Interest and Recovery of Debts Laws (Amendment) Bill, 2011, which was approved by voice vote in the Lower House, seeks to convert any part of debt into shares of defaulting company by the asset reconstruction company. The Bill was introduced in Lok Sabha in December 2011.

 

RUSSIA TO DELIVER ADMIRAL GORSHKOV BY 2013-END

The delivery of aircraft carrier Admiral Gorshkov— rechristened as INS Vikramaditya—would take place in the last quarter of 2013, Defence Minister A.K. Antony told the Rajya Sabha on December 12, 2012. On whether government proposes to levy penalties on the Russian side for failing to stick to the delivery schedule, he said, "As per contract, liquidated damages are to be ascertained and levied within six months of ship's delivery."

JOURNALISTS' CONFERENCE HAMMERS OUT SOLUTIONS TO INDO-PAK CONFLICT


India and Pakistan need fresh ideas   for   solutions   to festering wounds of history, analysts stressed at a two-day conference as part of The Times of India and Pakistan's Jang group's Aman ki Asha initiative in second week of December, 2012. The analysts called on the two countries to move forward on areas of synergy than being stuck on disputes.

Core Areas of Dispute

Experts from both sides, including retired diplomats and former generals, discussed ways to move forward on core areas of dispute—Sir Creek, Siachen and Kashmir. On Sir Creek, retired officials, who have formerly been key interlocutors for both the sides, came up with a road map for solving the dispute. The experts pointed out that a joint survey carried out in 2007 was 'a very successful effort in coordination and working at the professional level'.

They agreed that Sir Creek was 'not an intractable dispute'. While spelling out a step-by-step approach to its resolution, they urged the two governments to create a maritime park, or a zone of disengagement where fishermen from both sides can freely fish to paper over areas where they fail to find agreeable borders.

Siachen

On Siachen, a sub-committee drew up a detailed road map that they said was 'doable'. They said both sides should agree to withdraw from the conflict area "While retaining the option of punitive action should the other side renege on the commitments"

They called for the setting up of a joint civilian commission to delineate the line beyond NJ 9842, the northern point of the Line of Control and beyond which is Siachen. They suggested that the two sides could agree to disengagement and demilitarization according to a time frame and establishment of a joint scientific centre to study environmental issues. They also called for joint management of the demilitarized zone.

Kashmir

The session on Kashmir saw the complex realities of history and bitterness of the past boiling over, with stark difference of opinion marking the consultations. However, with the understanding to move forward to find a solution, the participants called for an in depth Kashmir conference to discuss all its socio-political and economic aspects. Participants of the conference should  be  from  civil society  of  India,  Pakistan  and Kashmir, they agreed, "Ideally, this conference will be held in Srinagar and Muzaffarabad, with the inaugural session in one city and concluding in the other," a joint statement said. Participating in a televised discussion in the concluding part, eminent personalities from both sides agreed that the two countries need to find common ground to move forward than wait for thorny issues to be resolved.

Former foreign secretary Shyarn Saran said India and Pakistan need to draw lessons from the experience of South-East Asia and other regions of the world where economics has trumped historic divides and free trade regions have brought countries together. Former cabinet secretary Naresh Chandra echoed Saran, while calling for a new approach.

Former Pakistan high commissioner to India Shahid Malik said both sides need to move faster on the outstanding issues, while agreeing with the argument that the two countries cannot make their people hostages to disputes.

INDIA-RUSSIA BILATERAL SUMMIT

·         India-Russia ink 10 defence pacts worth $ 4 billion

·         They trumpet new partnership.

·         Putin raises Sistema issue during talks.

During Russian President Vladimir Putin's state visit to India in the last week of December 2012, several agreements were signed between the two countries. These include defence deals worth around $ 4 billion.

 (Rs. 22,000 crore) signed on Dec.24 following comprehensive talks, including on differences over $ 3 billion investment by Russian telecom major Sistema, whose licence was cancelled.

Mr. Putin and Prime Minister Manmohan Singh underlook an extensive review of bilateral cooperation, especially in the field of nuclear energy and discussed ways to expedite an agreement for nuclear reactor 3 and 4 at Kudankulam. All key bilateral issues, including defence, space, trade & investment, science and technology, education, culture and tourism were discussed in the meeting which also witnessed Russians raising their concerns over the issue of Sistema. Sistema, with investment of $ 3.1 billion, has 56.68% stake in Shyam Sistema Teleservices (SSTL) whose 21 out of 22 licences were cancelled by the Supreme Court on February 2 as irregularities were found in their allocation.

The Russian government, which has a stake of 17-14% in the company, has since been expressing concern and pressing India to ensure protection of Sistema's investments.

Russia and India also resolved to further extend their partnership in the energy sector, which has moved beyond investment (Sakhalin-I) to direct trade (Gazprom-Gail) and is now seemingly set for joint investment in downstream and upstream sectors. India put its interest areas on the table equity participation through ONGC—OVL in existing and new projects in Siberia, Russia's Far East and the Arctic Shelf besides interest in acquiring equity stake in discovered or producing assets and in proposed Liquefied Natural Gas (LNG) projects in Russia.

$ 2 billion Investment Consortium to be set up

 
Russian sovereign wealth fund Russian Direct Investment Fund (RDIF) on December 24, 2012 signed a pact with State Bank of India (SBI) for setting up a $ 2 billion investment consortium for promoting investments between the two countries.

The RDIF and SBI would each invest up to $ 1 billion in the consortium, a statement issued by the Russian sovereign wealth fund said.

The entities would team up to facilitate access to long term capital in Russia and India and actively promote mutual investments.

Bolstering Ties  

·         Russia will sell 71 military helicopters for $ 1.3 billion to India.

·         India will also get technological kits to assemble 42 Sukhoi jet fighters for $ 1.6 billion.

·         Russian sovereign wealth fund inks pact with State Bank of India for setting up a $ 2 billion investment consortium.

As part of its developmental trials, Beyond Visual Range Air-to-Air Missile (BVRAAM), Astra was successfully launched from Chandipur, Odisha, in December to validate its reconfigured propulsion, control and guidance systems.

The launch was carried out against an electronic target, altho4h Pilotless Target Aircraft Lakshya was used to check the effectiveness of systems such as the ground radar. Defence Research and Development Organisation (DRDO) scientists said that the trial was only a rehearsal.

Astra is envisaged to intercept and destroy enemy aircraft at supersonic speeds in the head-on-mode at a range of 80 km and in tail-chase mode at 20 km.

INDIA, ASEAN FINALISE FTA IN SERVICES AND INVESTMENTS

·         A valuable milestone in our relationships, says Manmohan Singh.

·         Trade to reach $ 100 billion by 2015.

India and the Association of South-East Asian Nations (ASEAN) on December 20, 2012 finalised the much awaited Free Trade Agreement (FTA) in services and investments. The more is likely to boost trade to $ 100 billion by 2015

"It gives me great pleasure to see that our commemorative summit... coincides with the conclusion of negotiations for the FTA in services and investments. This represents a valuable milestone in our relationship. I am confident that it will boost our economic ties in much the same way the FTA in goods has done," Prime Minister Manmohan Singh said in New Delhi while addressing the ASEAN India Commemorative Summit in New Delhi on December 20, 2012.

After operationalizing FTA in goods last year, both sides were engaged in widening the base of the pact by including  services  and investments.

At present, trade between India and ASEAN stands at $ 80 billion. Dr. Singh said that following the simple mentation of FTA in goods, trade grew by 41 per cent in 2011-12 "Two-
way flows in investments have also grown rapidly to reach $ 43 billion over the past decade. As ASEAN investments into India have multi-
plied, ASEAN countries too have emerged as major destinations for Indian   companies.   From   energy resources to farm products, from materials to machinery, and from electronics to information technology, Indian and ASEAN companies are forging new partnerships of trade and investment," he remarked.

Commerce and Industry Minister Anand Sharma said that it was a matter of great satisfaction that India and ASEAN had been able to conclude the services and investments agreement.

Besides FTA with ASEAN, India is negotiating similar market opening pacts with members of the grouping. India has already implemented FTA with Singapore and Malaysia and is negotiating with Indonesia and Thailand in this regard. The FTA would also pave the way for discussions on a regional comprehensive economic partnership (RCEP) that ASEAN plans to seal with its six key trade partners, which include India.

India had been demanding that ASEAN open up its service sector further, including  steps  to  cover independent  professional  services and contractual service suppliers at all levels. It is learnt that after a tough round of negotiations on December 19, India agreed to drop its request for independent professional services and as a trade-off, ASEAN dropped its request for prudential measures in financial services. The final legal documents on services and investment pact is likely to be given a further shape by February 2013, and the signing could take place in August next year during a consultation between ASEAN economic ministers and Indian Minister for Commerce and Industry Mr. Anand Sharma in Brunei Darussalam.

ASEAN   and   six   partners— Australia, China, India, Japan, South Korea and New Zealand—will start first-round talks on the RCEP next year, which are expected to form the world's economic bloc in 2015.

RAILWAYS TOPS IN GRAFT COMPLAINTS CVC REPORT


Railways topped the list of government organisations in 2011  against  which  the  maximum  number  of complaints of corruption—nearly 9,000—were received by the Central Vigilance Commission (CVC).

As many as 8,805 complaints of alleged corruption were received against Railways employees followed by 8,430 against bank employees and 5,026 against incometax officials, the CVC said in its annual report.

A total of 4,783 complaints were received against personnel in the government of national capital territory of Delhi and 3,921 against employees working under the Urban Development Ministry during 2011.

Besides, the CVC got 2,960 complaints of corruption against employees working under the information and broadcasting ministry, 1,918 against the department of telecommunications, 1,877 against petroleum ministry officials, 1,544 against the food and consumer affairs department and 1,296 against the Custom and Excise Department among others, the report said.

The CVC, in its report tabled in Parliament recently, also noted delays and deficiencies while processing corruption-related cases by certain government departments

INDIA SUCCESSFULLY TEST-FIRES AGNI-I BALLISTIC MISSILE

 

Sharpening its missile prowess, India on December 12, 2012 successful' test-fired it’s indigenously developed nuclear capable Agni-I ballistic missile with a strike range of 700 km from a test range off the Odisha coast.

The surface-to-surface missile was test-fired from a mobile launcher from the Integrated Test Range at Wheeler Island about 100 km from Balasore. Describing the test as successful,   ITR   Director MVKV Prasad said, "It was a practice trial conducted by the Strategic Force Command of the Indian Army."

Agni-I, a single-stage missile powered by solid propellants, has a specialised navigation system which ensures that it reaches the target with a high degree of accuracy and precision, a defence scientist said. Weighing 12 tonnes, the 15-metre-long Agni-I is capable of carrying payloads up to   1000 kg and has already been inducted into the Indian Army. Agni-I has bem developed by advanced systems laboratory, the premier missile development laboratory of the Defence Research and Development Organisation in collaboration with Defence Research Development Laboratory and Research Centre Imarat  and  integrated  by  Bharat Dynamics Limited, Hyderabad. The last trial of the Agni-I missile was successfully carried out on July 13, 2012 from the same test range.

INDIA BLACK MONEY FLOW EIGHTH HIGHEST

The Hindustan Times carries a report which says that India is among the top ten developing countries in the world with black money outflow of US $ 1.6 billion in 2010, a news reported to be released in December 2012 claimed.

A report of Washington based Global Financial Integrity said the total outflow of black money from India since Independence till 2010 was US $ 232 billion, generally in form of corruption, bribery and kickbacks. Illicit assets during,the same period totalled $ 487 billion.

"This means that almost three-quarters of the illicit assets comprising India's underground economy—which has been estimated to account for 50% of India's GDP (approximately $ 640 billion at the end of 2008)—ends up outside of the country," said Dev Kar, the report's author and a former IMF economist.

The report, Illicit Financial Flows from Developing Countries, whose earlier edition has been quoted by the government in its white paper on black money, is an attempt to evaluate illicit financial flows from around 150 developing and emerging economies.

And it found illicit financial flow in 2010 from these countries was US $ 858.8 billion, just below the all-time high of US $ 8713 billion in 2008—the year preceding the global financial crisis. Maximum outflow of illicit money was from China and five oil rich middle-east countries among the top ten.

The report said astronomical sums of dirty money continue to flow out of the developing world and into offshore tax havens

CABINET COMMITTEE CLEARS NEW UREA INVESTMENT POLICY

The Cabinet Committee on Economic Affairs on December 13, 2012 approved a urea investment policy which is likely to incentivise fertiliser companies to set-up new plants and expand existing capacity.

India imports over 30 per cent of its urea requirements and the policy aims at reducing that. But it is unlikely to have any impact on existing prices.

The policy, which aims to attract fresh investment of about Z 35,000 crore to increase domestic production by eight million tonnes, has been cleared as the previous policy failed to attract the much needed funds.

Under the new policy, the government will give 12-20 per cent post-tax return on fresh capital infused by the manufacturers for setting up of new plants as well as for expansion and revamp of the existing ones.

To ensure this return, the government would cover the entire cost of natural gas, which is the main feedstock of urea, and accounts for 80 per cent of the cost. The government controls the urea sector and has fixed the Maximum Retail Price (MRP) at 5,360 a tonne.

The difference between the MRP and the cost of production is given as subsidy to manufacturers.

For determining the cost of production of new plants to be set up after the policy comes into effect, the government has set a floor and ceiling price of urea, based on the price of natural gas plus 12-20 per cent equity returns.

The importance of the National Investment Board, now renamed the Cabinet Committee on Investments (CCI), rests here. (Its) clearance for the CCI will now hopefully ensure that some of this gargantuan backlog is dealt with. The CCI proposal was circulated by Finance Minister P. Chidambaram as a cabinet note, around the same time that the commerce minister issued the press note for FDI in multi-brand retail. The slow progress of both proposals illustrated that the objection to reformist ideas can emanate from the opposition as well as the ruling party.

The cabinet approval for the CCI will, of course, have to fine-tune some issues. For instance, there will soon be clarity on whether all investment plans of above 1,000 crore will travel to the CCI, or only those where all other options have failed, including a reference to the cabinet and the cabinet committee on economic affairs. Also, since all ministers from the infrastructure sector will be part of the CCI, it stands to reason that some of the Groups of Ministers (GoMs) could be disbanded. The key change, however, should be the collective recognition that once the .CCI takes on a project, it will provide the final seal of approval."

The ASEAN member countries are looking forward to establish a strategic partnership with India in the days to come in the larger interest of peace, progress and shared prosperity in the region, the ASEAN Economic Ministers Chair Cham Prasidh said in Guwahati on December 17, 2012.

Speaking at the conclusion of the 8,000 km ASEAN India car rally on Dec. 17 Prasidh, also senior commerce minister of Cambodia, said that while ASEAN's  engagement with India had conclusion of the just  completed 20 years, the 10-nation regional group was looking at Indian PM Manmohan Singh to announce elevation of the ASEAN-India relationship to a strategic level.

"While today's arrival of the ASEAN-India car rally is a historic landmark in our relationship with India, we are looking ahead to the leaders of ASEAN joining the Indian Prime Minister in a commemorative Summit between ASEAN and India to mark the 20th year of our relationship. We are going to see in next three days our leaders announcing that our relationship would be elevated to another level which is strategic partnership level," Prasidh said.

Describing the Northeast as a gateway between India and ASEAN, Prasidh also said that the meeting of ASEAN representatives with leaders from the Northeastern states was the beginning of another chapter for building up ASEAN-India relationship.

Earlier, welcoming the ASEAN representatives, D. Purandeswari, MoS for Commerce, described the car rally as one that would help further promote trade, commerce and tourism. The 31 cars that took part in the rally had arrived here on December 16 evening through Myanmar.

After the Baltic nations it is Malta's turn to project itself as the 'gateway to Europe' and woo Indian investment. Even as it tries to catch up with its richer counter parts in the European Union, the island nation, however, appears a bit choosy about the investment that comes its way.

Though Malta Enterprise, a government agency to promote investments, claims anyone can come to Malta and set up a business, its chief officer Trade, Investment and Enterprise a Support, Joe Schembri says they are not too keen on foreign retail chains that may hit the domestic market.  "Businesses that will find the country conducive for growth and help Malta too grow in the process," that is what they are looking for. Malta's wishlist for Indian investors include pharmaceuticals, software development, manufacturing of electrical equipment as well as aircraft and superyacht registration. And it is offering fiscal incentives in the form of 30-50 per cent rebate on the capital costs, no import duty and easy taxation.

Listing its geographical and demographic advantages, Schembri says that unlike several other EU nations Malta is an English speaking country, thanks to its shared colonial history with India.

Besides, it has good air and sea connectivity, sound legislation and political stability due to a two-party system that seems to have a single voice on most economic politics, Malta charges 35 per cent corporate tax, but also has a system of up to 30 per cent refunds—tax paid by the company is credited to the shareholder upon a distribution of dividends. Besides a no-profit-no-tax policy, Malta has a double taxation avoidance agreement with 65 countries, including India.

Indian drug major Aurobindo Pharma set shop in Malta in 2008 to cater to the European market. The facility now dispatches close to 4,000 batches of medicines a year, which it plans to increase to 6,000 by 2015, says Federici( Schembri, MD of Aurobindo Pharma (Malta) Ltd. and Jonathan Farrugia, Qualified Person for Batch Release (Europe).  Since  Vijay  Mallya's  superyacht,  Indian Empress, is registered under the Malta Flag, the country hopes other high-net-worth individuals from India would follow suit while looking at yacht registration. Inviting Indians to also register their aircraft with it, Transport Malta offers services ranging from aircraft maintenance and repair to aircraft management. UAE CABINET APPROVES EXTRADITION TREATY WITH INDIA

The United Arab Emirates cabinet has approved an extradition treaty with India which will allow extradition of around 1,200 Indian convicts languishing in the Gulf nation to ,their home country to spend the remaining jail term.

The agreement was signed by the two- countries in November 2011. The treaty is expected to help around 1,200 Indian prisoners who are serving jail term in UAE prisons.

According to the agreement approved by the Cabinet on the prisoners will have a choice to spend the remaining prison term in India, state-run WAM, news agency reported.

A similar 'agreement signed between the UAE and Pakistan was also ratified and the arrangement of transport procedures discussed.

INDIA INKS PACT WITH UKRAINE ON NUCLEAR SAFETY

In a bid to enhance safety of its increasing number of nuclear plants, India on November 10, 2012 inked a pact with Ukraine on Nuclear Safety and Radiation Protection to take advantage of the country's expertise in the crucial sector.

Four other pacts, including framework agreement to expand defence ties were also inked between the two countries after comprehensive talks between Prime Minister Manmohan Singh and Ukrainian President Viktor Yanukovych during which they agreed to forge a comprehensive partnership between their countries.

Noting that they exchanged views on nuclear energy and nuclear safety, where they can learn a great deal from each other, Singh said, "The unfortunate Chernobyl accident has given Ukraine valuable insight and knowledge in dealing with this critical issue. Through the Agreement that has just been signed between the nuclear regulatory authorities of both sides, we have agreed to share our experiences in nuclear safety and radiation protection."

The nuclear disaster in April 1986 at the Chernobyl Nuclear Power Plan in Ukraine (then official Ukrainian SSR) is one of only two classified accidents as a level 7 even on the International Nuclear Event Scale, the other being the Fukushima Dailchi nuclear disaster in 2011.

Significantly, some of the experts working in Kudankulam nuclear plant are of Ukrainian origin.

In a press statement, the Prime Minister also said that the two countries were already undertaking a number of defence cooperation projects and December 10's, defence cooperation agreement establishes a new framework for expanding this cooperation.

PRESIDENT'S HOUSE TURNS PEOPLE-FRIENDLY

[To host 200 public visitors for 'change of guard' ceremony]

In a significant move towards making Rashtrapati Bhavan people-friendly, it has been decided to make the ceremonial 'change of guard' of the President's Bodyguard open to the public every Saturday, Rashtrapati Bhavan will host 200 public visitors at its forecourt for watching the ceremony.

The   ceremony that entails a series of military traditions—from bugles and bands  to  the horse riding President's Bodyguard (PBG) will have a new look as the drill will be conducted in the back drop of the presidential house from the earlier North Block.

"We have decided to lift all restrictions with regard to the change of guard ceremony and about 200 people will be able to enter the forecourt. The changes have been made on the instructions of President Pranab Mukherjee, who is very particular about the fact that this place should be open and accessible to the common man," said Venu Rajamony, the President's press secretary. During winter, the ceremony will start at 10 am every Saturday, he added.

Change of guard is a military tradition whose origins are lost in antiquity. From time immemorial, guards and sentries at palaces, forts and defence establishments change periodically to enable a fresh body of troops to take charge. The ceremony was first opened to the public in 2007. Since assuming office, President Mukherjee has not only revamped the ceremony, but also relocated it to make more visually appealing and people-friendly.
While  the  PBG  is  permanently  based  in  the President's Estate, the Army Guard Battalion—currently the 28th Battalion of the Madras Regiment—is selected from among the elite infantry regiments of the Army and is turned over every three years.

PARLIAMENT APPROVES FDI IN RETAIL

The Indian Parliament has approved the Foreign Direct Investment in retail. FDI in multi-brand retail got the approval of the Lok Sabha on December 5, 2012 as the opposition motion seeking immediate withdrawal of the decision was rejected convincingly as BSP and SP walked out.

While 218 voted in favour of the opposition motion, 253 voted against it in the House where 471 members participated in the voting. The total strength of the House is 545. The House also rejected the motion seeking amendment to the rules notified by the Reserve Bank under Foreign Exchange Management Act (FEMA) to enable FDI in multi-brand retail. While 254 voted in favour of the government, 224 were against.

Members of SP and BSP, with respective strength of

22 and 21, did not participate in the voting as they walked out alleging that interests of farmers and small retailers had been ignored.

This was after a gap of many years that an executive decision of the government was put to vote in Parliament

The Motion in the. Rajya Sabha

The ordeal was over for the UPA government which won the vote on the policy on FDI in multi-brand retail sector in the Rajya Sabha on December 7, 2012 with generous help again from the Bahujan Samaj Party (BSP) and the Samajwadi Party (SP).

Just before the Opposition motion was put to vote, the SP walked out, reducing the effective strength of the House by nine members. The BSP's 15 MPs voted against the motion that 'disapproved' of the government's decision to allow 51 per cent FDI in multi-brand retail sector. The BSP said it backed the UPA to thwart Opposition attempts to demand the resignation of the Manmohan government on the ground that it did not enjoy a majority. The final vote count was 102 in favour of the motion and 123 against.

Now the FDI policy in multi-brand retail having received the approval of Parliament, the way is clear for the government to carry out more economic reforms without any hindrance, though of course public opinion across the board was not in favour of the induction of FDI in retail. Those who oppose the policy are of the view that the implementation of the policy will adversely affect the small retails throughout the country who constitute a sizable part of India's population. The opponents of the FDI in retail also claim that the approval of the Parliament was a manipulated affair by the government since those who supported the policy in the Lok Sabha numbered only 253, 20 members short of the half mark 273. The nation has to wait and watch how things unfold further as the majority of parties in Parliament are against it.
