THE NCTC TO FUNCTION UNDER IB
[Opposition seates have their way; the NCTC will not have search, seizure and arrest powers]
The Government has decided that National Counter Terrorism Centre (NCTC) will function under the Intelligence Bureau (IB) without search, seizure and arrest powers as demanded by State Governments.
The salient features of the proposed NCTC are to be thrashed out during a conference of State Chief Ministers on Centre-State relations and Administrative Reforms Commission scheduled in Delhi on April 15, 2013.
Dec. 23, 2009: Home Minister P. Chidambaram proposes NCTC on lines of its US counterpart. The NCTC was housed within IB with search, seizure and arrest powers.
April 2010: PC writes note on NCTC to PM and circulates, it to finance, defence and Foreign Ministers. Leaders feel that after NCTC, Home Minister will get all powers.

2010-2011: CMs, including Naveen Patnaik, Jayalalitha, Mamata Banerjee and Narendra Modi oppose NCTC.
2011-2012: Sushil Shinde as Home Minister agrees with state, wants NCTC without search and seizure powers.
Dec. 2012: Home secy R.K. Singh moves a note for Cabinet putting NCTC outside the IB. Intelligence chiefs oppose it.
March 2013: NCTC without search and seizure powers but within the IB.
The decision to house NCTC within IB was taken following concerns expressed by intelligence agency chiefs on keeping the NCTC as an independent entity, while doing the same counter-terrorism work as the Bureau.
The move will make the proposed counter terrorism body an expansion of the Multi Agency Centre (MAC) having a similar brief of collating, analysing and disseminating intelligence to State Governments. The MAC was strengthened post 26/11 Mumbai attacks and is presently headed by a Joint Director.
